How This Calculation Works: Plain-English Legal Breakdown

Under Dubai Decree No. 43 of 2013, rent increases upon lease renewal are governed by how far your current rent sits below the official RERA rental market average:

  • Up to 10% below market: 0% increase permitted.
  • 11% to 20% below market: Maximum 5% increase.
  • 21% to 30% below market: Maximum 10% increase.
  • 31% to 40% below market: Maximum 15% increase.
  • More than 40% below market: Maximum 20% increase.

Worked Example: Current Rent AED 60,000 vs RERA Average AED 80,000

1. Rent Gap: AED 80,000 - AED 60,000 = AED 20,000 below market.

2. Gap Percentage: (AED 20,000 / AED 80,000) × 100 = 25% below market.

3. Legal Bracket: 25% gap falls into the 21%–30% band, permitting a maximum 10% increase.

4. Permitted Rent: AED 60,000 + (10% of AED 60,000) = AED 66,000 / year (an increase of AED 6,000).

5. Notice Requirement: Landlord must serve written notice at least 90 days before lease expiry. Without 90 days notice, the increase is nullified.

Who Is NOT Covered By This Law?

Commercial properties not covered by the residential index, properties leased in Abu Dhabi, Sharjah, or northern emirates which have separate municipal rent laws.

Edge Cases Handled

No increase is permitted if rent is within 10% of market average. Landlords must give at least 90 days written notice before lease expiration; without 90 days notice, the increase is legally null and void.
