Understanding Power of Attorney (POA) in the UAE
A Power of Attorney is a binding legal instrument whereby one party (the Principal) formally authorizes another individual or entity (the Attorney-in-Fact or Agent) to manage affairs, execute agreements, represent them before government entities, or conduct transactions on their behalf.
Under UAE Federal Law No. 5 of 1985 (Civil Transactions Law), a Power of Attorney must be strictly notarized by an official government Notary Public (such as Dubai Courts Notary Public or ADJD Notary) to possess legal validity.
General POA vs Special POA
- General Power of Attorney: Grants sweeping, broad authority to the agent to manage personal finances, operate bank accounts, sign corporate contracts, represent the principal before ministries, and manage properties. Because of the substantial legal risk, banks and land departments impose strict scrutiny on General POAs.
- Special Power of Attorney (Recommended for Most Tasks): Strictly restricts the agent's mandate to a clearly defined transaction or task. Examples include:
- Property Management / Sale POA: Authorizes buying, leasing, or selling a specific real estate parcel identified by title deed number.
- Vehicle Transfer POA: Authorizes transferring or renewing registration for a specific motor vehicle at the RTA.
- Litigation POA (Tawkeel Khass): Appoints a licensed UAE advocate to represent you in court proceedings.
- Inheritance Representation POA: Appoints an agent to distribute estate assets before probate courts.
Remote Digital Video Notarization
Both Dubai Courts and the Abu Dhabi Judicial Department now provide 100% remote digital notarization. Principals can execute a valid UAE Power of Attorney from anywhere in the world without visiting a court branch:
- Draft Bilingual Document: The POA must be drafted in professional legal Arabic, or bilingual side-by-side English and Arabic.
- Submit via Digital Court Portal: Upload the draft and supporting IDs to the Dubai Courts or ADJD Digital Notary portal.
- Authenticate via UAE Pass: The principal logs in and verifies identity using verified biometric UAE Pass.
- Join Remote Video Hearing: An official government Notary Public initiates a secure live video conference call. The notary verifies your visual identity, confirms your mental capacity and free will, and reads the key clauses of the document.
- Digital Signing & Issuance: You sign the document electronically via OTP / digital cryptographic key. The officially sealed Power of Attorney containing an encrypted verification QR code and judicial serial number is issued instantly via email.
