1. What Constitutes a UAE Final Settlement?
An end-of-service final settlement (often referred to as final clearance) is the formal accounting reconciliation between an employer and employee upon separation. Under Federal Decree-Law No. 33 of 2021, the settlement must incorporate all accrued statutory rights:
- End-of-Service Gratuity (Article 51): Computed on the last drawn basic salary for workers who completed at least one full continuous year of service.
- Unpaid Wages for the Final Month: Pro-rated for every calendar day worked up to the official termination date.
- Unused Annual Leave Encashment (Article 29(9)): Cash settlement for untaken statutory leave, calculated on the basic wage.
- Notice Period Compensation (Article 43): If the employee was terminated without requiring service of the notice period (gross wage basis).
- Repatriation Ticket: Mandatory if the employee does not take up alternative employment in the UAE and departs the country.
2. The Mandatory 14-Day Payment Rule (Article 53)
Article 53 of the Labour Law sets a strict, non-negotiable statutory deadline:
"The Employer shall pay the Worker, within fourteen (14) days from the date of the contract termination, his remuneration and all other entitlements stipulated in this Decree-Law..."
Employers cannot withhold settlements pending annual financial audits, commercial handovers, or visa quota clearances. If payment is delayed past 14 days, the employer enters default.
3. Statutory Deduction Limits (Article 25)
Employers may legitimately deduct funds from a final settlement only for authorized liabilities, such as outstanding company loan balances, salary advances, or proven damage to company property.
However, under Article 25, total deductions cannot exceed 50% of the worker's monthly remuneration without formal judicial order or MOHRE approval. Furthermore, deductions for recruitment fees, visa applications, or mandatory health insurance are strictly prohibited under federal regulations.
4. Step-by-Step Escalation If Settlement Is Withheld
Send a formal, dated demand notice citing Article 53 of Federal Decree-Law No. 33 of 2021 and highlighting the expiration of the 14-day statutory timeline.
Do not sign the MOHRE/ICP visa cancellation clearance form until funds have been fully credited to your bank account. Signing the form certifies that all entitlements have been received.
Log into mohre.gov.ae or use the MOHRE App with UAE PASS to register a formal labour dispute. MOHRE legal conciliators will schedule a hearing within 14 days to resolve the matter.
