1. Statutory Legal Rules for Notice Periods
Under Article 43 of Federal Decree-Law No. 33 of 2021, both the employer and employee may terminate a standard fixed-term employment contract for any legitimate reason, provided that the terminating party serves written notice to the other party.
The statutory notice period must strictly comply with two mandatory boundaries:
- Statutory Minimum: Not less than thirty (30) calendar days.
- Statutory Maximum: Not more than ninety (90) calendar days.
Any contract clause requiring an employee to serve a notice period exceeding 90 days—even if agreed upon in a private corporate offer letter—is null and void to the extent of the excess under UAE public order rules.
2. Duties and Wages During the Notice Period
During the notice period, the employment relationship continues under full statutory obligations:
- The employee is obligated to perform regular duties in full according to normal working hours.
- The employer is obligated to pay full remuneration (basic wage and all monthly allowances) on the regular payroll cycle.
- Notice periods cannot run concurrently with authorized annual leave or maternity leave unless mutually confirmed in writing by both parties.
3. Pay in Lieu of Notice (Article 43(3))
If either party elects to waive or shorten the notice period without the consent of the other, or terminates the contract with immediate effect, the terminating party must pay compensation in lieu of notice.
Calculation Basis: Under Article 43(3), compensation in lieu of notice is computed strictly on the basis of the worker's last gross remuneration (basic salary plus regular allowances). This contrasts with end-of-service gratuity, which is computed strictly on basic wage.
4. Right to Job-Search Days (Article 43(5))
A critical protection introduced in the UAE Labour Law is the statutory right to seek alternative employment during employer-initiated notice periods:
- If the employer issues termination notice, the worker is entitled to take one (1) working day per week (or up to 8 hours across the week) as unpaid leave to attend interviews and job search appointments.
- The employee must give the employer at least three (3) days' prior notice specifying the intended absence day.
